Terms & Conditions

These Terms govern your use of the DersTakip mobile app and the derstakip.app website (together, the "Service"). By using the Service you accept these Terms.

How we handle personal data is described in our Privacy Policy; the scope of the software license is in the EULA.

1. Eligibility

The Service is intended for students who want to track and improve their study habits. You must be at least 13 years old to use the Service. If you are between 13 and 18, we recommend that a parent or legal guardian review the Service before you create an account. We will close any account if we later determine that the holder is under 13.

2. Your account

• You can create an account with email + password, or via Google, Apple, or Facebook sign-in.
• You are responsible for keeping your credentials secure and for everything done through your account.
• Don't share your password. If you suspect unauthorized access, contact info@derstakip.app immediately.
• You can close your account at any time from the Account Removal page. See the Privacy Policy for deletion details.

3. Premium subscription and payment

• Core DersTakip features are free. Premium features are available via in-app subscription.
• Subscription pricing, billing cycles, and refund policy are managed by Apple App Store or Google Play Store. All purchases and cancellations are processed through the relevant store under its terms.
• Subscriptions auto-renew. You can cancel at any time through your store account (App Store / Play Store → Subscriptions). You will retain Premium access for the remainder of the paid period.
• Refund requests are subject to the relevant store's refund policy; refund decisions are made by Apple or Google.

4. Acceptable use

When using the Service, you agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Harass, threaten, defraud, or otherwise abuse other users.
• Provide false information or impersonate another person.
• Attempt unauthorized access to the Service's infrastructure; reverse-engineer the app (except as expressly permitted by applicable law); upload malicious code.
• Use bots, scrapers, or automated tools to make excessive requests or to manipulate rankings, in-app coins, streaks, or other systems.
• Send advertising or spam; collect personal data from other users without authorization.
• Resell or commercially redistribute the Service.

We may warn, suspend, or close accounts that violate these rules (see Section 8).

5. User content

Text, images, audio, and other content you share through the Service ("User Content") remain yours. You agree that:

• You have the right to share the content and it doesn't infringe anyone else's copyright, personality, or privacy rights.
• The content doesn't contain hate speech, discrimination, incitement to violence, sexually explicit material, child-sexual-abuse material, fraud, doxxing, or anything otherwise unlawful.
• When you post, you grant us a worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and create derivative works (e.g., weekly recap summaries) of your content, solely to operate and improve the Service. This license ends when you delete the content or close your account.
• We may remove, restrict, or moderate content that violates these Terms or community rules, with or without notice. Automated moderation is applied to images and text.

6. AI features

DersTakip uses AI services (OpenAI, Microsoft Azure OpenAI) for coaching chats and content recommendations. When you use these features:

• Your messages and contextual data (school, grade, target exam) are sent to those providers for processing.
• AI-generated responses may contain mistakes or be incomplete; do not rely on them for medical, legal, financial, or other critical decisions.
• You are responsible for how you use AI output; consult appropriate sources or professionals where needed.
• We advise against sharing sensitive personal data (national IDs, bank details, etc.) in AI chats.

7. Intellectual property

The DersTakip app, website, logos, brand, design, source code, and content (curriculum data, audio, animations) are the intellectual property of Ataberk Köroğlu or its licensors. You are granted a limited, non-transferable license to use the Service for personal, non-commercial purposes. All other rights are reserved.

8. Suspension and termination

We may suspend or close your account, with or without prior notice, if you breach these Terms or applicable law. In such cases your Premium subscription may also end, and any refund will be subject to the relevant store's policy. You may close your account yourself at any time from the Account Removal page.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". We do not warrant, express or implied, that DersTakip will be uninterrupted, error-free, virus-free, or fit for a particular purpose. Content within the Service is educational and is not professional advice.

To the maximum extent permitted by law, DersTakip will not be liable for any indirect, special, consequential, or punitive damages, including loss of data, profits, or reputation. Our total aggregate liability shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

10. Changes to the Service and these Terms

We may add, remove, or change features. We may also update these Terms from time to time. For material changes we will notify you by in-app message or email. Continuing to use the Service after an update means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes arising from these Terms or use of the Service shall be brought before the Istanbul (Anadolu) Courts and Enforcement Offices. Consumers retain the right to bring proceedings before consumer arbitration boards and consumer courts.
